The Pierre Pierce Warrant

The Cedar Rapids Gazette reprinted the entire text of the Pierre "I've Got Your F***ing Laptop" Pierce (as he will forever be known to you in this forum) search warrant and made it available to all of the public on their usually closed web site. Kudos to them. Now I'm going to copy and paste it right here, although I'm going to leave out the victim's name and address information:

Affiant: Detective Thomas Boyd

Occupation: Police Officer No. Years: 17

Assignment: Criminal Investigations No. Years: 11

Your affiant conducted an investigation and received the following information

On the date of 1-27-05 at 22:53 hrs, WDMPD officers were dispatched to the address of [VICTIM'S ADDRESS] regarding a domestic disturbance. Officers (Kincaid and Giampolo) made contact with the persons involved in the disturbance, who were identified as [VICTIM] and Pierre Antoine Pierce. At that time there was no report/complaint of physical violence or assault and the parties ([VICTIM] and Pierce) were separated and Pierce left the residence.

On the date of 1-28-05 at approx. 19:00 hrs Officer Kincaid - WDMPD was dispatched to the address of [VICTIM'S ADDRESS] to meet with [VICTIM] regarding a "public assist." [VICTIM] reported to officer Kincaid that after WDMPD officers had been to her residence the night before, on 1-27-05 at 22:53 hrs, her ex-boyfriend identified as Pierre Pierce had agreed to leave her residence. [VICTIM] reported that after the WDMPD officers left her residence, Pierce returned to her residence and is reported to have entered [VICTIM]'s apartment without her permission. It was reported that Pierce began to argue with [VICTIM], and physically grabbed [VICTIM] by the arm and forced her onto her couch. It was reported that Pierce was in a rage and was yelling profanities at [VICTIM]. It was reported that at one point Pierce threw her to the floor and stated words to the effect "if you scream, make a sound, or breath, it will be the last breath." It was reported that Pierce went into [VICTIM]'s kitchen and grabbed a knife, it was reported that Pierce walked around the kitchen with the knife in his hand. Pierce then returned to the living room. It was believed that he had left the knife in the kitchen.

[VICTIM] reported that she then attempted to leave her apartment, however Pierce refused to allow her to leave and would not let her out of the door. [VICTIM] reported that she then ran upstairs to her bedroom and went into her bedroom and locked the door to the room. [VICTIM] stated that Pierce then began to attempt to force open her bedroom door however was not able to gain entry into her bedroom. [VICTIM] reported that after a short period of time she believed that she could hear her apartment entry door being opened and then shut. At that time she believed that Pierce had left her residence. [VICTIM] reported that she then exited her bedroom and went to her front door as she was going to lock the door.

[VICTIM] reported that when she got downstairs, she observed Pierce still inside her residence and was in the living room. [VICTIM] reported that Pierce forced her onto the floor in the living room, and began to remove her clothing. It was reported that Pierce was on top of [VICTIM] and grabbed her by the neck/throat and began to choke her. It was reported that Pierce was making statements to [VICTIM] that were sexual in nature, and was confronting her about her new boyfriend. It was reported that after a period of time, Pierce allowed [VICTIM] to put her clothing back on.

[VICTIM] reported that after she got her clothing back on she ran for her apartment door and fled the apartment and ran to her vehicle. It was reported that Pierce chased her to her car and attempted to keep her from driving away by reaching into the vehicle and grabbing on to the steering wheel. [VICTIM] reported that she was able to get the car started, and put the car into reverse. At that time Pierce let go of the steering wheel and [VICTIM] was able to drive away from the area.

[VICTIM] reported that she drove to a friends house and spent the night with a friend. v stated that she did not return back to her residence until approx. 19:00 hrs on 1-28-05. When [VICTIM] returned home she found the interior of her apartment to have been badly damaged. It was reported that her personal belongings were thrown about the floor, flowers and plants had been pulled from their pot's and thrown on the floor, it was reported that her bedroom furniture had been damaged, her television and stereo had been pulled from the entertainment center and thrown to the floor, it was reported that all of her clothing had been removed from drawers and closet's and were thrown about the floor, photographs and picture frames had been destroyed and broken glass was scattered about the floor.

It was discovered that [VICTIM]'s lap top computer had been removed from the residence. It is also reported that a disposable camera was removed from the residence. It was reported that Pierce had questioned [VICTIM] about the camera during the night of the incident and had asked [VICTIM] what was on the camera, and if there were pictures of her new boyfriend.

[VICTIM] provided officers the e-mail communication from Pierre Pierce dated Friday 1-28-05 12:... p.m.). This communication is from sender: Pierre-pierce@uiowa.edu in this communication the author makes statements to include: I know last night got real bad, but even when we got unexpected company you still showed me that you had my back, you could have very easily turned on me and made things a lot worse ... You constantly lie to me and I really took it out on your bedroom yesterday I was absolutely ... probably the most upset that you will ever see me." "I am truly sorry for your report and your papers I threw on the ground all I wanted to do was talk to you and you fleed probably because you were scared and I understand but I thought for sure that you would come back but you didn't so that made me go ballistic like never before.

On 1-29-04 [VICTIM] met with this affiant, and provided a voice message that was left on [VICTIM]'s cellular phone by Pierce on the date of 1-28-05 at 12:41 p.m. In this message Pierce states words to the effect: "Hey I forgot to tell you I got your lap top computer ... was typing my paper last night ... I didn't go to sleep, I didn't get no sleep ... was up all ... I couldn't print it off obviously so I just took it with me. I got your fucking lap top ..." [VICTIM] confirms that the person leaving this message is Pierre Pierce.

On the date of 1-29-05 your affiant contacted Sgt. Vicki Lalla Iowa City Police Department. Your affiant had learned through [VICTIM] that Pierce resided in the city of Iowa City in Johnson County in the "Pheasant Ridge" apartment complex on Bartelt Road. Sgt. Lalla contacted the manager of the Pheasant Ridge Apartments (Steve ...) who confirmed that Pierre Pierce does reside at the Pheasant Ridge Apartments complex, and confirmed his (Pierce) address as 2402 Bartelt Road Apt. #2C - Iowa City, IA.

Due to the information provided to law enforcement by [VICTIM] it is believed that Pierce has possession of [VICTIM]'s property (Gateway Lap Top Computer) as well as a Silver and Yellow colored disposable 35mm camera.

Considering the description of the trashed apartment and the fact that he went into the apartment after the victim fled, I take back my earlier statement about the burglary charge being something trumped up. He obviously went in there to take things.

UPDATE: I originally had the Cedar Rapids Gazette's santized and spell-checked version of the Pierre Pierce email here, but I've since updated it to the Daily Iowan's uncensored and uncorrected version (login: tacobell, password: gordita):

Just imagine what the victim has been through over the past couple of years while being Pierce's girlfriend and then deciding to break up with him and get another boyfriend. There's probably zillions of emails, voicemails, and text messages that could tell a very awful story of terrorism and sexual violence.

I'm going to do a rare thing and agree with Rekha Basu of the Des Moines Register on something she said on November 17, 2002:

How do you mediate when sexual assault is charged? I don't think you do.

From a Tom Witosky piece in the Des Moines Register on November 11, 2002 - this makes Roxanne Conlin look even worse:

By pleading guilty, Pierce avoided trial on a Class C felony charge of third-degree sexual assault and possible placement on the state's sexual-offender list. In addition, he was allowed to remain on campus, and he could play basketball next season.

The deal was struck by Pierce's lawyers, Alfredo Parrish and Maggi Moss the victim's lawyer, Jerry Crawford and Roxanne Barton Conlin, a former U.S. attorney who served as mediator. The agreement was reached within a month of Pierce's arrest.

"This case would not have closed with these agreements that have been reached without Parrish's, Crawford's and Conlin's involvement," Johnson County Attorney J. Patrick White said. "Crime victims don't want to be identified. They fear being ostracized by family and friends. I actually think the potential of this case is a message of empowerment to victims."

Conlin, a victims' rights advocate, said the process could be used by other prosecutors in their pursuit of convictions in acquaintance sexual-assault cases. "There is a chance for broader application of the process we used in this case," she said.

Legal experts and other victims' rights advocates said last week that they knew of no other acquaintance sex-crime case in which mediation was used to avoid a trial.

"Mediation is used in some criminal cases but not very often, and I know of no case in which it was used in a sexual-assault case in this way," said Andrea Charlow, a mediation expert at the Drake University Law School.

Everybody involved back then with "the deal" looks pretty bad now, don't they?
